Malawi realizes the important role Foreign Direct Investment (FDI) plays in the economic growth and development of any country. In its poverty reduction and growth strategy, the country highlighted the need for creating an enabling environment for attracting FDI in an effort to stimulate private sector driven growth and poverty reduction.

The government encourages both domestic and foreign investment in most sectors of the economy without restrictions on ownership, size of investment, source of funds, and destination of final product.

There is no government screening of foreign investment in Malawi. Apart from the privatization program, the government's overall economic and industrial policy does not have discriminatory effects on foreign investors. Since industrial licensing in Malawi applies to both domestic and foreign investment, and is only restricted to a short list of products, it does not impede investment, limit competition, protect domestic interests, or discriminate against foreign investors at any stage of investment.

Since January 2002 foreign nationals have been prohibited from buying freehold property under the (revised) Malawi National Land Policy, though foreigners may obtain leases, either from the Government, or from private owners. Foreigners already owning property are under pressure to become Malawi citizens, to retain freehold ownership.
